In the last few days of 2024, the Malaysian Inland Revenue Board (MIRB) has issued a completely revised transfer pricing guideline, which affects many aspects such as permissibility to prepare minimum transfer pricing documentation, exemption from having to prepare annual transfer pricing documentation, interpretation of ‘control’ to determine which transactions are in the ambit of transfer pricing documentation and computation of arm’s length range.  

Concurrently, the transfer pricing audit framework has also been updated. The new information from this update include the mechanism of the imposition of the penalty of RM20,000 to RM100,000 for failure to prepare transfer pricing documentation on contemporaneous basis.
